Please read this Electronic Communications Disclosure ("Consent") carefully. It contains important information. "We," "us," and "our" refer to Thatch Health, Inc. "You" and "your" refer to the person giving this consent. Terms used and not defined in this Consent have the meanings given to them in the Thatch Platform Terms, available at https://thatch.com/legal/platform-terms.
If this is a consumer transaction (meaning a transaction you are entering into for personal, family, or household purposes), we are required by law to provide you with certain information related to this transaction "in writing" – which means you have a right to receive that information on paper. However, with your consent, we may provide this information to you electronically, instead.
For both consumer and business transactions, we also need your general consent to use electronic records and signatures. If you do not consent to use electronic records and signatures, you will be unable to proceed electronically.
After you have read this information, if you consent to the use of electronic records and signatures please select the acceptance option provided.
1. What Information We Will Provide Electronically
This Consent applies to all agreements or amendments; to approve purchases, billing, or debiting Financial Accounts or Reserves; to receive, accept, or waive Healthcare Notices or adopt Healthcare Payments Accounts related to Services; to receive tax forms and other reporting documentation related to the Services (“Tax Documentation”); and for other transactional purposes related to these Platform Terms or the Services (collectively, “Documentation”). Your consent does not obligate us to provide any information to you electronically. We may, at our option, deliver any information to you on paper should we choose to do so.
2. Your Consent
You agree that any of the Documentation we provide to you, or that you sign or agree to at our request, may be in electronic form. This consent will last unless you revoke it. We may also use electronic signatures and obtain them from you on any Documentation.
By consenting to use electronic signatures, you agree that any electronic signatures that you provide are valid and enforceable as your legal signature and acknowledge that these electronic signatures will legally bind you to the terms and conditions contained in the disclosures and agreements we provide you, just as if you had physically signed the same documents.
We may provide the Documentation electronically by any one or more of the following means: (1) your email address; (2) your online account, however you access it; (3) our website; (4) by your accessing a website that we will designate in an e-mail, text message or other electronic notice; or (5) through any other method we disclose to you at the time we provide you with the Documentation.
3. Your Right to Obtain Paper Copies
You will have the opportunity to print out and retain a copy of all the documents you review or sign as part of this transaction.
4. Updating Contact Information
It is your responsibility to provide us with accurate and complete e-mail address, phone number, and other contact information, and to maintain and update promptly any changes in this information. We are not responsible for any communications you do not receive if we sent them to your e-mail address, phone number, or other contact information that we have on file for you.
You may update your contact information with us at any time by emailing us at support@thatch.com.
5. System Requirements to Access Information
To complete this transaction and receive information electronically you must have:
an Up-to-Date Version (defined below) of an Internet browser we support,
a connection to the Internet,
an Up-to-Date Version of an email management program,
an Up-to-Date Version of a program that accurately reads and displays PDF files (such as Adobe Acrobat Reader),
an active email address, and
a computer or mobile device and an operating system capable of supporting all of the above.
You will also need a printer if you wish to print out and retain records on paper, and electronic storage if you wish to retain records in electronic form.
In some cases, you may also need a specific brand or type of device that can support a particular software application, including an application intended for particular mobile or handheld devices.
By "Up-to-Date Version," we mean a version of the software that is currently being supported by its publisher.
6. How to Withdraw Your Consent
You may withdraw your consent to receive Communications electronically at any time by contacting us at support@thatch.com. Your withdrawal of consent will be effective after we have a reasonable period of time to process it. Withdrawing your consent does not apply to Documentation (including Tax Documentation) delivered to you before the date on which your withdrawal of consent takes effect.
If this is a business transaction, withdrawing consent also does not affect any agreement you make in any Documentation to use electronic records and signatures in the future.
Please keep in mind that Thatch provides modern, web-based solutions. Where you withdraw consent, access to specific services will be limited if available at all, and you may be required to close your Thatch Account.
7. Consumer Transactions
If this is a consumer transaction, you have the following additional rights:
Obtaining paper copies - You have a right to obtain paper copies of any information we are required to provide you "in writing." Any request for paper copies of Documentation will not be treated as a withdrawal of your consent to receive Documentation electronically. In addition to having the opportunity to print copies of documents you review and sign as part of the transaction, you may also request a paper copy of any information provided to you electronically by contacting us at support@thatch.com. We will not charge you a fee for any paper copies you request.
Changes in hardware or software requirements - If our hardware or software requirements change, and that change creates a material risk that you would not be able to access or retain the information or complete the transaction, we will give you notice of the revised hardware or software requirements. Continuing to access information or complete the transaction electronically after receiving notice of the change reaffirms your consent.
Rights Applicable to Tax Documents.
Receiving Paper Versions: If you do not consent to receive Tax Documentation electronically, we will furnish the Tax Documentation to you in paper format to the address we have on file for you.
Availability: Tax Documentation will be available through your online account for two full calendar years after the year it is furnished. For example, a Form 1095 furnished in January 2026 will be available through your online account until January 2028. However, if you close your account, your access to the Documentation electronically may be terminated. After such closure, please refer to “Obtaining paper copies” above.
Withdrawal of Consent: We will notify you (either electronically or on paper) when we have confirmed the withdrawal of your consent to receive Tax Documentation electronically, and the date in which such withdrawal takes effect.
8. Acceptance and Consent
By consenting to these terms, you agree to the following:
I acknowledge that I have read and understand this Consent about the use of electronic records and signatures;
I consent to the use of electronic signatures and records in connection with the Services;
I consent to receive information electronically in connection with the Services;
I acknowledge that I am able to receive, access, and view the information presented electronically via the methods described above, and
I acknowledge that the electronic signatures and records will be in place of written documents and handwritten signatures.
